JAMMU, Apr 3: In a Public Interest Litigation (PIL) against unplanned digging and frequent traffic jams, Division Bench of High Court comprising Chief Justice MM Kumar and Justice Muzaffar Hussain Attar today issued directions to the Divisional Commissioner, Jammu.
After hearing Senior Advocate BS Salathia, Advocate Abhinav Sharma and Advocate Meenakshi Salathia, the DB observed, “an updated status report has been filed by the Divisional Commissioner, Jammu in pursuance of order dated March 24, 2014. Nothing has been revealed about the approximate expenditure incurred for preparing the roads for blacktopping as also the nature and quality of work, which is undertaken by the ERA before handing over the roads for blacktopping/macadamization”.
“Various agencies like PWD(R&B), NBCC and Municipal Corporation are involved in the work of blacktopping. The thickness of the blacktopping and the approximate age to which it could last as per the stipulations in the contract agreement has also not been highlighted”, the DB further observed, adding “information in this regard assumes significance in view of the assertion made by the counsel for the PIL asserting that the blacktopping, which has been done recently, has developed huge holes and pots on the roads causing accidents”.
“Advocate Abhinav Sharma has shown some photographs to us and has also sought time to file counter to the updated status report as well as the additional information to highlight the quality of work concerning blacktopping and pre-blacktopping preparations”, the DB said.
With these observations, Division Bench directed Divisional Commissioner, Jammu to furnish all the details along with relevant documents. The counsel for the PIL may also file his counter to the updated status report, the DB further directed.
