JAMMU, Sept 2: In a Public Interest Litigation (PIL) filed by one Varun Jamwal seeking quashment of advertisement whereby applications were invited for recruitment of Gang Coolies from the permanent residents of Jammu, Samba and Kathua districts, Division Bench of State High Court comprising Justice Virender Singh and Justice Tashi Rabstan today issued notice to Chief Secretary, Commissioner Secretary PWD and Superintending Engineer PWD Jammu-Kathua Circle.
The petitioner submitted that in the advertisement it has been stated that pay and allowances for initial period of five years of service shall be governed by the Govt. Order No. 257-F of 2011 dated 27.10.2011. Vide this order fixed salary for first 2 years shall be Rs 3170 and for next 3 years shall be Rs 4610. The petitioner termed the advertisement as discriminatory on the ground that the Government order No.257 – F of 2011 has already been repealed and withdrawn.
After hearing Advocate HC Jalmeria appearing for the petitioner whereas Deputy AG DS Jamwal appearing for the State, DB issued notice to Chief Secretary, Commissioner Secretary PWD and Superintending Engineer PWD R&B Jammu-Kathua Circle which was accepted by Deputy AG on behalf of respondents.
The Division Bench requested Senior Advocate Sunil Sethi to assist the Court in this petition and directed Registry to provide copy of the petition to Advocate Veenu Gupta assisting Counsel for Senior Advocate Sunil Sethi.
