JAMMU, Nov 15: In a Public Interest Litigation (PIL) highlighting the inaction on the part of the Government to deal with the situation caused by the unprecedented floods in the State especially in Jammu region, Division Bench of State High Court comprising Chief Justice MM Kumar and Justice Tashi Rabstan today passed various directions regarding relief to the flood victims
After hearing Advocate A P Singh for the PIL filed by two practicing lawyers namely Ajay Bakshi and Tariq Rasool whereas Senior AAG Gagan Basotra for the State, DB observed, “the distribution of relief as per the report of the Committee constituted on the directions of Supreme Court is not up to the claim made by the State Government”.
“The common man in the flood affected areas in district Udhampur has not been benefited to the extent claimed by the State Government. The prevailing situation in village Saddal has been sketched by the committee”, the DB said, adding “Advocate A P Singh appearing for the PIL has placed on record the detail of 30 families where either no relief has reached or the relief given is very meager”.
“The perusal of the application shows that Sat Pal Sharma, Kashmir Singh, Puran Singh, Sampuran Singh and Sukhdev Singh have not been given any relief, whereas they have suffered huge loss. The relief given to others is in hundreds. A specific reply is required to be filed with regard to those families, which are residents of Phalain Mandal and Satwari”, the DB.
Accordingly, the DB requested the President and the Executive Members of the Bar Association Jammu to point out such cases where the relief has not been given by furnishing detail to Advocate AP Singh, who shall place the same on record so that appropriate directions are issued.
“A specific report shall be filed by the Divisional Commissioner Jammu within two weeks. In the meanwhile, counsel for the petitioners may bring on record the names of families, who have not been given adequate relief in the same manner as has been pointed out in respect of 30 families”, the DB said.
