DB restrains respondents from admitting any student of reserved categories

JAMMU, Apr 2: In a Public Interest Litigation (PIL) filed by one Ashok Sharma, a social activist challenging Rule 17 of Reservations Rules, Division Bench of High Court comprising Chief Justice M M Kumar and Justice Muzaffar Hussain Attar today restrained respondents from admitting any student of reserved categories in excess of their quota.
After hearing Advocate Kuldip Singh Parihar appearing for the PIL whereas Senior AAG Gagan Basotra for the State, Advocate Anil Sethi for the BOPEE and Advocate Pawan Kundal for the private persons, DB observed, “the objections filed by State respondent are absolutely vague and do not disclose any substantive basis for framing the impugned Rule”, adding “the only statement made in the objections, in nut shell, is that the Rule is valid which has been framed under Article 15(5) of the Constitution. Such an affidavit is of no assistance to the Court”.
The Division Bench directed the State counsel to produce the record, which led to the framing of Rules along with reasons, object and title. The DB further directed respondents not to admit any student belonging to the reserved categories in excess of their quota as the stand already taken by J&K BOPEE.
