DB’s directive to Floriculture Deptt

JAMMU, Dec 21: Division Bench of State High Court comprising Chief Justice M M Kumar and Justice Hasnain Massodi has directed Floriculture Department to file status report with regard to each and every park and measures taken to the develop the same so as to create proper lung area for the residents of Jammu.
This direction was passed in a Public Interest Litigation (PIL) regarding encroachment of forest land. On the last date of hearing final opportunity was granted to the Floriculture Department to file status report. But the department failed to do so.
After hearing Advocate Ajay Abrol for the PIL whereas Deputy AG Neeru Goswami for the State and Advocate S S Nanda for the JMC, the Division Bench observed, “status report was also required to be filed with regard to the steps taken in pursuance to the directions dated July 31, 2012 to develop forests on both sides of Tawi river in order to save the forest land from encroachment. However, no status report has been filed by the respondents”.
While directing the department to file status report within a week with advance copy to the counsel for the petitioner, the DB said, “this will be subject to the payment of Rs 5000 as costs, which will be deposited with the legal service authority”. The DB has also directed the registry to list the PIL in second week of February 2013 for hearing.
