Editor convicted in cheque bounce case

JAMMU, Sept 9: Munsiff Jammu Parveen Pandoh today convicted Vijay Gupta, editor of a local newspaper, in two cheque bounce cases punishable under Section 138 Negotiable Instrument Act, 1881.
The editor was sentenced to simple imprisonment of one year and a fine of Rs 2000 in each case and in case of default in payment of fine he shall undergo simple imprisonment of 10 days.
According to the cases filed by Yash Pal Singh, the complainant was running a garment shop at Sarwal and when he shared his plan of upgrading the business establishment with variety of garments, the accused offered help on the pretext that he can arrange a good deal of garments at reasonable prices from Delhi.
The complainant having confidence and trust upon the accused asked him to arrange the supply of garments for the complainant’s business at Jammu. Thereafter, the complainant paid Rs 6,15,000 to the accused on different dates which the complainant had arranged from his friends and relatives.
However, no supply of garments was made and when the complainant threatened accused of legal action, Vijay Gupta issued cheques for an amount of Rs 1,15,000 and Rs 2, 50, 000 in favour of complainant being part payment towards the return of legally enforceable debt of Rs 6,15,000.
However, both the cheques were dishonoured by the banks prompting the complainant to knock the doors of the court.
