Ensure compliance of all provisions of Drugs & Cosmetics Act: DB

JAMMU, July 25: In a Public Interest Litigation (PIL) filed by Indigenous Medicines Organization, Division Bench of High Court comprising Chief Justice Gita Mittal and Justice Sanjay Dhar has directed the Principal Secretary to Government Health and Medical Education Department to ensure compliance of all the provisions of Drugs and Cosmetics Act, 1945 and the Drugs and Cosmetics Rules, 1945.
In the PIL, it has been submitted that Ministry of AYUSH has addressed a letter to all States and UTs regarding licensing requirement for Ayurveda, Siddha and Unani drugs as per Rule 158-B of the Drugs and Cosmetic Rules, 1945 but there is no mandatory compliance of the Rules.
After hearing both the sides, the DB observed, “notices issued to the respondents on January 18, 2020 have not been received back so far”. Accordingly, DB ordered that subject to the petitioner’s taking steps, fresh notice is issued to the respondents returnable on October 21, 2020.
The DB further directed that notices shall be additional served digitally. AAG Aseem Sawhney accepted notice on behalf of Department of Health and Medical Education. The DB directed the Health and Medical Education Department to file reply before the next date of hearing and ensure compliance of all the provisions of Drugs and Cosmetics Act, 1945 and the Drugs and Cosmetics Rules, 1945 including Rule 158-B of the Drugs and Cosmetics Rules, 1945 in the Union Territory of Jammu and Kashmir.
