JAMMU, Aug 21: In a PIL filed by Haji Miya Saria seeking directions to bring an end to discrimination with the trans-genders by the educational institutions, Division Bench of High Court comprising Justice Virender Singh and Justice Tashi Rabstan today directed Chief Secretary to constitute a high-level committee under his chairmanship preferably within two weeks and formulate a comprehensive scheme for addressing the problems of trans-genders strictly in tune with the directions issued by the Apex Court.
After hearing Advocate DS Chouhan with Advocate Meharban Singh for the PIL whereas Senior AAG Gagan Basotra for the State, the DB observed, “till the high level committee is constituted at least direction of the  Supreme Court can be complied with without any waste of time”.
The DB directed State to immediately step into it and ensure that proper measures are taken to provide medical care to trans-genders of the State in the hospitals besides providing separate public toilets and other facilities.
The Division Bench also exempted personal appearance of Commissioner Secretary GAD for today and directed Senior AAG Gagan Basotra to appraise the court of the compliance of the order on next date of hearing.
Earlier, Advocate Chouhan submitted that there are hardly 150 souls from this community in Jammu and Kashmir and it appears that the State is not inclined to address their problems despite there being specific directions by Supreme Court.
