JAMMU, Aug 3: Joint Action Committee of General Category people of J&K today called on BB Vyas, Advisor to Governor, here at Jammu and stressed for no reservation in promotions of Government servants.
The JAC which was led by Ved Prakash Sharma, convener and comprising Ramesh Gupta, president of Mahajan Sabha, Narayan Singh, president of Rajput Sabha and others, told Vyas that the hue and cry created by vested elements on reservation in promotions are aimed at just creating atmosphere of animosity among the communities by taking partisan approach.
Ved Parkash Sharma impressed upon the administration through BB Vyas that those occupying constitutional positions must desist from such partisan approach and allow the law to take its own course. He said that JAC has full faith in the leadership of Governor NN Vohra.
Narayan Singh said that the constitutional sovereignty guaranteed under Article 370 shall not be allowed to be diluted and stand taken by Government in the Supreme Court in the SLP No 32820 of 2015 titled Mohammed Haneef lone Vs Ashok Sharma will always be guiding force on this issue. “The matter is still under consideration of Supreme Court and no further orders have been issued in this SLP which actually pertains to state of J&K”, he added.
The High Court of J&K in its landmark judgment dated 9.10.2015 in the case titled Ashok Kumar Sharma Vs State of J&K had quashed the reservation in promotion rules abnitio. The judgment has been delivered based on the two premises. One was that 77th Amendment of Constitution of India was not extended to the state of J&K and accordingly Article 16(4) which grants reservation in promotion does not get directly implemented in J&K because of the presence of Article 370 in the State. Secondly there is no quantifiable data to prove the backwardness of the reserved category people in the State which is mandatory as per law.
