Non-regularization of Incharge DySPs

JAMMU, Oct 24: In a contempt petition filed by Incharge DySPs, High Court has directed AAG Raman Sharma appearing for Principal Secretary Home Department and Director General of Police to ensure compliance of order dated October 4, 2019 whereby directions were issued for finalization of the seniority list and also regularization.
When the contempt petition filed by DySPs (OPG) Ashok Kumar Chib and Mohd Ibrahim came up for hearing, Advocate Sheikh Shakeel Ahmed with Advocates Supriya Chouhan and Mohd Zulkernain Chowdhary appearing for the petitioners submitted that neither compliance report has been filed nor the Home Department has placed on record the decision of the State Administrative Council whereby it was decided to finalize the seniority of the DySPs including those working on Incharge basis/OPG and also to regularize their services.
On the other hand, AAG Raman Sharma appearing for the Home Department submitted that the directions of the writ court have been complied with as both the petitioners in the contempt petition have been regularized and nothing remains to be adjudicated.
After considering the submissions of both the sides, Justice Tashi Rabstan allowed further two weeks time to AAG Raman Sharma to ensure compliance of the order dated October 4, 2019 by filing a detailed status report with regard to the finalization of the seniority list of DySPs and also their regularization. The court further directed that in case the needful is not done within two weeks, then appropriate orders shall be passed against the officers of the Home Department.
