HC directs constitution of SIT to probe killing

SRINAGAR, Nov 28: Taking serious note what it called the tardy pace of the investigations, Jammu and Kashmir High Court today directed the Inspector General of Police, Kashmir, to constitute a Special Investigation Team (SIT) into the killing of a youth in 2010 police firing at Khanabal in Anantnag district.
The court directed the SIT should be headed by a police officer who should not be below the rank of Superintendent of Police.
A Single Bench of the High Court comprising Justice Ali Mohammad Magray while hearing the petition filed by the father of the deceased youth, Bilal Ahmad Najar, who was killed in 2010 unrest in police firing, observed that the concern of the court has not been registered by the respondents seriously despite repeated orders passed by the court from time to time, and sufficient time given for concluding the investigation.
After being pulled up by the court for tardy pace of investigation, the Additional Advocate General submitted that there was no deliberate delay in investigation and respondents have implemented the orders of the court.
AAG also submitted the Investigating Officer (Uday Bhaskar) has assumed the charge of Additional SP Anantnag on November 15 this year.
Bhaskar, who was present in the court, submitted he has recorded the statements of the witnesses in Urdu which have been sent for translation in English, therefore, he could not proceed further.
The court also directed the head of the SIT shall file detailed status report before next date of hearing, and investigation authority has been directed to examine and consider the list of witnesses under Section 164 A provided by the petitioner for recording their statements in terms of the law before the Magistrate concerned.
Najar was allegedly killed in police firing in 2010 public unrest along with another youth Noor-ul-Amin Dagga when they were purportedly waiting outside a Masjid at Khanabal for offering funeral prayers of a student, Maroof Ahmad Shah, who had drowned after forces allegedly had chased some person in September that year.
