JAMMU, July 15: High Court has directed the Commissioner Secretary PWD to initiate enquiry against the then Assistant Executive Engineer PWD posted at Sub-Division Banihal with regard to the issuance of contradictory certificates and complete the same within a period of six weeks.
After hearing Advocate O P Thakur appearing for the petitioners in writ petition titled Samreen & Anr V/s State of J&K & Ors and Z S Watali, AAG for Education Department and Advocate Sheikh Shakeel Ahmed with Advocate Irfaan Mohd. Khan for the private respondents, Justice Tashi Rabstan observed, “it is contended that the then AEE PWD (R&B) Sub-Division Banihal issued two certificates dated 05-01-2012 wherein distance from Shokerpora to Gujjarnar, Chachall has been shown 200 meters (approximately) and distance from Mirpora to Gujjarnar Chachall has been shown 180 meters (approximately)”.
“Advocate Sheikh Shakeel Ahmed appearing for private respondents has drawn the attention of the court to another certificate dated 09-01-2012 wherein the distance from village Chachall to Shakerpora to Upper Gujjarnar has been shown 1.90 km by foot (approximately)”, Justice Rabstan said, adding “according to Advocate Ahmed the AEE has pushed the poor villagers of tehsil Banihal to a uncalled for litigation which is pending since 2010 and ultimate casualty is the students belonging to lower strata of the society”.
After hearing both the sides, Justice Tashi Rabstan directed that it would be appropriate to direct the Commissioner/ Secretary to Government PWD (R&B) to initiate enquiry against the then Assistant Executive Engineer PWD (R&B) posted at Sub-Division Banihal with regard to the issuance of the contradictory certificates regarding distance.
“The Commissioner Secretary PWD (R&B) is directed to complete the enquiry within a period of six weeks and the enquiry report be submitted before the next date of hearing”, Justice Rabstan said.
