JAMMU, Apr 29: High Court today issued directions for deferring the State Medical Faculty Examination for the April-May session scheduled to be held in terms of the date sheet.
These directions were passed in two petitions filed by Jeewan Joyti and Others and Mohd Tariq and Others.
According to the petitioners, the High Court Vide order dated April 23, 2013 passed the direction to the official respondents to declare the result of students of the petitioners institutes for Part-I course and entertain the examination forms for Part-II course and permit the students of the petitioners’ institutes to take the examination. Entertainment of examination forms and consequent result of the examination for the course will remain subject to the eligibility and dependent on the result of the Part-I examination as also outcome of the main petitions. Furthermore, it shall be solely at the risk and responsibility of the students.
After hearing Senior Advocate K S Johal and Advocate Ankush Manhas appearing for the petitioners, Justice Tashi Rabstan issued notice to State and others and ordered that subject to objections from the other side and till next date the respondents shall defer the State Medical Faculty Examination for the Session April-May, 2013 scheduled to be held in terms of date sheet.
“It appears that order was passed in the presence of counsel for the respondents whereas the counsels appearing for the petitioners submitted that respondents have issued date sheet for conducting examination of all the eligible Para Medical Trainees of AMT/ANMT Schools/Private Para Medical Institutes of J&K. It is contended that official respondents are not allowing the petitioners to participate in Part-II Course Examination despite the order dated April 23, 2013 passed by this Court”, the High Court said, adding “it is also contended that in case official respondents are allowed to go according to the scheduled fixed in the date sheet for examinations of Part-II course and the petitioners are not allowed to appear in the examinations, the petitioners would miss the bus with a serious consequence of suffering in future prospectus apart from remaining in the institutes at the huge expenses of their parents.
