JAMMU, Sept 20: In a contempt petition filed by Rajesh Gupta, Incharge Superintending Engineer, High Court has directed the Secretaries of Rural Development Department and Public Service Commission to ensure compliance of the order or appear in person on next date of hearing.
The Incharge SE Rural Development Department moved the contempt petition for seeking implementation of order dated March 2015 whereby the respondents were directed by the court to consider his case for release of grade of Executive Engineer from 1996 and grade of SE from 2008 within six weeks.
The petitioner, who appeared in person stated at Bar that Shafat Noor Barlas, the then Secretary Rural Development Department has now been superannuated from service and the new incumbent namely Khurshid Ahmad Shah has filed affidavit dated 30.06.2016. However, the name of Khurshid Ahmad Shah has not been substituted. On this, Justice Tashi Rabstan directed the Registry to carry out necessary correction.
Taking serious note of delay in implementing the directions, Justice Rabstan observed, “despite opportunities, needful has not been done and in the interest of justice, four weeks time is granted to do the needful failing which Secretary Rural Development Department and Secretary PSC shall appear in person on next date of hearing”.
