HC quashes advt notification for Medical Officer posts

SRINAGAR, Dec 19: High Court has quashed the advertisement notification for the posts of Medical Officers and directed the authorities to take fresh selection process strictly in accordance with the terms and conditions of the notification within two months to its logical conclusion.
The case before the court was projected that 20 posts of Medical Officers (AYUSH), 2 male and 2 female for each zone were put to advertisement by the authorities in the month of October 2013 and in respect of Khanyar zone 2 posts of male MOs (AYUSH) only two application were received by the respondents and both after due process were selected in the year 2014.
Some aggrieved candidates against the selection approached the court and succeeded in halting the selection process by obtaining restraint order on selection process and finally the case of the aggrieved candidate got dismissed in 2017 and the instant case before the court was that since the petition has been dismissed and the authorities are under legal obligation to conclude and finalize the selection process.
But instead of further proceeding in the selection process, the authorities issued another advertisement notice whereby the posts of MOs have been re-advertised. Authorities contended before the court that two posts of MOs for block Khanyar were inadvertently notified and subsequently a notification with corrigendum were issued where-under only one vacancy of male MO was shown against block S R Gunj in Srinagar and the vacant post of MO under medical block zone Khanyar has been kept reserved till determination of the instant petition.
Justice Ali Mohammad Magrey after having heard the parties said the restraint order was granted by the court in relation to the subsequent advertisement and the said restraint order has already been vacated by dismissing the petition leaving no option for the authorities but to take the selection in question to its logical conclusion in terms of initial advertisement.
“…All the advertisement notifications/corrigendum issued by the respondents with regard to the posts in question subsequent to the initial notification of 2013 shall stand quashed qua the said posts only”, Justice Magrey said and directed the authorities to take selection process in relation to the posts in question to its logical conclusion, strictly in terms of the initial advertisement notification preferably within two months.
