SRINAGAR, Aug 24: High Court today reserved its orders in JKCA multi crore scam in which former Chief Minister, Dr Farooq Abdullah, is among accused.
The Division Bench of Chief Justice N P Vasanthakumar and Justice B L Bhat reserved its orders on PIL seeking probe into the misappropriation of funds on huge quantity in JKCA in the year 2012 after hearing the parties.
Matter was argued on the point that whether any agency apart from Police can investigate the matter as BCCI is party in the matter and whether in such circumstance state probing agency can sought records from BCCI.
The counsel appearing on behalf of respondents made submissions before the court that u/s 177 of RPC, police have the powers to investigate the matter regarding any outside State agency (BCCI). The submissions were made jointly by senior Advocate R A Jan (representing Ehsan Mirza) and advocate Javed Iqbal ( representing Dr. Farooq Abdullah) when court put a query that can Crime Branch investigate the matter as BCCI is also party in the case and have they powers to sought records from BCCI.
Advocate Javid Iqbal who represents Dr. Farooq Abdullah submitted that handing over the probe to some other agency besides present probing agency (Police) would suggest to turn the clock anticlockwise as the police has already completed the investigation to some extent.
Court also observed: “We want the investigation into the matter should be completed without any further delay”.
On last date of hearing State had submitted that they have no objection if the investigation into the matter is handed over to any other agency.
The instant PIL was filed by the two persons namely Majid Yaqoob Dar and Nissar Ahmad Khan who remained Ranji Trophy and Club Level Players respectively.
