HC seeks details about infra, facilities in schools

Srinagar, Sept 20: High Court today sought information from the Government on infrastructure and facilities in the schools as per laid down norms.
The direction followed after the State counsel submitted norms of all educational institutions (Government as well as Private recognized) under court directions. The norms have been filed along with status report supported by an affidavit of Commissioner Secretary to Government Education Department.
As per the status report, J&K follows the infrastructure and other facilities in schools run by the Government, as provided under centrally sponsored schemes (Sarvasiksha Abhiyan and Rashtriya Madhiamik Siksha Abhiyan).
Court said the former scheme is in respect of primary and upper primary schools while the later pertains to secondary and higher secondary schools. Commissioner of Education in his report submits that norms of private schools operating across the State are required to full fill the conditions laid down in Education Rules of 2010 notified under SRO 123.
The SRO provides the procedure for registration of private schools and its Rule 6 provides necessary infrastructure and facilities required for a private schools seeking permission, recognition or extension or renewal.
Commissioner Secretary along with his status report has placed on record the basic features of Sarva Shiksha Abhiyan and the frame work of Rashtriya Mahyamik Shiksha Abhiyan which indicate the basic features of SSA and requirement of infrastructure, learning resources, teachers and others and in respect of the RMSA.
As the court has been informed that the private schools operating in J&K have also been notified under SRO 123 dated 18.3. 2010. “Now the norms are in place and available, Dar submits that the data in respect of Government schools as also private schools is being collected. The same shall be presented before this court on the next date of hearing”, Division Bench of Chief Justice Badar Durrez Ahmad and Justice Ali Mohammad Magrey directed.
State counsel also submitted that the Commissioner Secretary Planning Development and Monitoring Department was required to file an affidavit explaining as to why the time period of two weeks was not complied with as indicated in order dated 13.9.17. He submits that the affidavit is ready and shall be filed shortly and not lesser than one week, prior to the next date of hearing.
Court also reiterated that the status of investigation about burning of schools be filed before October 13 for which court has already granted four weeks time to the authorities.
