Srinagar, May 29: High Court issued notice to Government for response to the PIL seeking Master plan (MP) and sustainable development for Bangus valley situated in north Kashmir.
The Public Interest Litigation has been filed by advocate Mir Umar, a resident of Kupwara showing his deep concern about the protection of the natural beauty and environment Bangus valley submitted before the division bench Chief justice N Kotiswar Singh and Justice Moksha Khujuria Kazmi the increasing footfall of tourists in the Bungus valley in the last couple of years.
He informed the court that the entire land covering Bungus is forest land and has not been transferred to LBDDA. The authority is not able to prepare a master plan for the development of Bungus. The road constructed a year ago is haphazardly through green pastures without any master plan.
The PIL mentions that in absence of the master plan the green valley of Bungus is under threat of haphazard constructions and allotments for commercial purpose which can prove fatal for the natural beauty of Bungus and its meadows, trees and streams.
The court as per these submissions made by the counsel for petitioner issued notice to Government to file their response within four weeks. The notice has been waived and a accepted by the Government counsel and sought four weeks time for response to the contentions raised in the PIL.
The petitioner has prayed to direct the forest department and LBDDA to Prepare the master plan for Bungus valley by following the procedure as envisaged in Jammu and Kashmir Developmental Act 1970 and in such a way that no concrete construction and building are allowed to be constructed in the Bungus valley and no allotment of land is made in haphazard manner in excess for commercial activities.
