SRINAGAR, Oct 27: High Court today issued notice to Central Government and Government of J&K and sought response to the plea seeking strict implementation to the provisions of the (Protection of Children against Sexual Offences) POCSO Act of 2012 in J&K Union Territory.
The Division Bench of Chief Justice Gita Mittal and Justice Sindhu Sharma issued notice to Secretary to Ministry of Home Affairs Government of India, Chief Secretary of J&K UT, Secretary to Home Department, Director Social Welfare Kashmir, Divisional Commissioners of both provinces of Kashmir and Jammu and sought response from them within four weeks.
The petitioner Musab Omer through his counsel Altaf Khan seeks strict implementation of the provisions of the POSCO Act which the advocate Khan submitted before DB has remained largely absent in the UT ever after its application.
He prayed that there is a need to make the application of the POCSO retrospective rather than prospective as such approached the court for its effective implementation. The litigation filed by petitioner-Omer highlights the violation and infringement of rights of minor children and other vulnerable groups with respect to the implementation of the Protection of Children against Sexual Offences Act, 2012 and prevention of crimes against them.
