JAMMU, Nov 17: In a petition filed by Mohammad Amin Malik and others versus State of J&K and others, the High Court has passed an interim order and stayed Jammu and Kashmir State Sports Council’s advertisement Notice inviting applications for the posts of Ground In-charges, Assistant Storekeepers, Electricians and some other posts.
Petitioners claimed to be working as Ground In-charges, Storekeepers and Electricians in J&K State Sports Council and were earlier working as daily rated workers/time scale employees in Sports Council and came to be regularized in terms of various orders as Class IV.
In view of their stagnation on these posts, the Council re-designated them as Ground In-charges, Assistant Storekeepers and Assistant Electricians in terms of Sports Council Order No 403 of 2016 and 404 of 2016, both dated 17-6-2016.
Court observed that if the Council’s Advertisement Notice for these posts is given effect, the rights of the petitioners guaranteed under Article 14 and 16 of the Constitution of India, would be jeopardized.
Thus Court passed the interim order that impugned Advertisement Notice shall stay and petitioners shall be allowed to continue in the present posts and they shall be paid the legitimate earned salary.
