JAMMU, Nov 20: High Court has stayed the operation and effect of order of suspension of Assistant Professor Ashu Jolly, who was arrested by the Vigilance Organization while accepting bribe of Rs 5000 from the student for approving her M.Ed. synopsis.
After hearing Advocate Abhinav Sharma appearing for the petitioner, Justice Alok Aradhe observed, “counsel for the petitioner has submitted that the petitioner was placed under suspension vide order dated 02.01.2017. However, till today even the charge sheet has not been served on the petitioner”, adding “the counsel for the petitioner has invited the attention towards Government Instruction (No.2) appended to Rule 31 of the J and K Civil Services (Classification, Control and Appeal) Rules, 1956 which states that in case it is not possible to conclude the departmental proceeding within three months from the date of suspension, the authority has to report the matter to the next authority explaining the reason for delay”.
“In the case of the petitioner, even this exercise has not been undertaken”, Justice Aradhe further observed and directed that operation and effect of order of suspension dated 02.01.2017 shall remain stayed till next date of hearing.
