H&ME Deptt posts tainted doctor on top 6 posts in ISM

SRINAGAR, Apr 11: Ministry of Health and Medical Education has posted a tainted doctor on six top posts in the Department of Indian System of Medicines (Health) blocking the chances of promotion of other doctors.
Dr Kabir Dar, who was posted as Director General of ISM Jammu and Kashmir, last year is holding 5 more posts of Director ISM J&K, Deputy Director ISM Kashmir Division, Chief Executive Officer State Medicinal Plants Board, Member Secretary Vanaspati Van Society and Mission Director AYUSH for last over a decade despite several cases against him.
Dr Kabir Dar has been elevated to the coveted post despite over half a dozen cases pending against him. He is accused in embezzlement of Rs 5 crores in Vanaspati Van Society J&K and the case is under investigation in Vigilance Department Srinagar (vide No SLK 46/2011).  Another case (Vide No 46/2013) of purchase of spurious drugs is under investigation in Crime Branch Srinagar. Case (Under SV No 14/2013) of sale of diploma certificates is under investigation against him in Vigilance Organization Srinagar. Case (Under PV No 53/2014) of sale of diploma certificates against him is under investigation in Vigilance Organization Jammu. An order (Vide order No SVC 167 Dated 10-09-2013) of inquiry was issued by State Vigilance Commission against him. Order of Inquiry was issued by Governor (No GS 557 (G) Apl/2013/3460 dated September 30, 2013) against Dr Kabir. A case (Vide No PVK 07/02/2015) of preliminary inquiry is pending in Crime Branch Srinagar against him.
As per the records, Dr Kabir has managed 3 DPC’s in his favour while no other officer of the department of any rank has been offered the chance of promotion. Dr Showkat Ahmad Yatoo, the only physician specialist in the department is posted at a Dispensary in a remote village of Wanpora in district Pulwama. He has not been promoted for the last 15 years, neither has been he transferred during this period when both Dr Kabir and Dr Yatoo were appointed as medical officers under same Government order (No 231 HME of 1993 dated 10-03-1993).
Dr Kabir has been harassing other doctors in order to stop their growth.  In a letter (No DG-ISM/7972 dated 03/03/2015) written to Dr Yatoo, he has threatened him of adverse entries in APRs/ACRs/Service records without citing any reason.
The letter reads: “As per Service conduct rules a Government employee is required to maintain high standards of integrity and not to do anything which is unbecoming of a Government servant. It has been observed that you are not improving your conduct.”
Dr Yatoo is not the only doctor but several other doctors are receiving similar kind of threatening letters. The Director General ISM has also shot a letter (No DG-ISM/7890 dated 28/02/2015) to another senior doctor, Dr Zahoor Ahmad Tantray, wherein he has also threatened him of Adverse entries in APRs/ACRs/Service records.
“It has been observed that for quite some time you are not correcting yourself to show improvement towards excellence. Your conduct is not improving constraining the department to effect adverse entry into your service records”, reads the letter addressed to Dr Zahoor.
Dr Kabir had also lodged a criminal case against Dr Zahoor in Police Station Zakoora but the investigations have found that he was being targeted. The SP Hazratbal in a communication (No SP (H)/2013/Clt/Rdr/88 dated 23/11/2013) to SSP Srinagar has written that a criminal conspiracy was hatched by Director ISM against Dr Zahoor.
Another FIR (211/2013) was lodged against Dr Zahoor at the behest of Dr Kabir in Police Station Sadder and misusing his position, he managed two day illegal detention of the doctor. But the SHO later in his report said FIR NOT ADMITTED. The SHO even recommended action under RPC 182 against the Director for misleading complaint. However, no action was taken against Dr Kabir.
