LC Chairman asks Govt to take women reservation issue seriously

JAMMU, Apr 5: Chairman Legislative Council Amrit Malhotra today directed the Government to look into the matter regarding  issuance of RBA or LAC certificates  so that genuine beneficiaries including women married to non-RBA area not  deprived of the benefit.
The chairman issued the directions after NC member Dr Shehnaz Ganai raised the issue through Calling Attention Motion in the House today.  It was  supported by several other members including Ravinder Sharma, Sheikh Ghulam Rasool and  others.  Dr Shehnaz said that if woman from RBA area is married to non-RBA area, she is deprived of the benefit of it after applying for job. And if a girl from non-RBA area is married to RBA area she again suffers as at least 15 years stay is needed in RBA area to have benefit of the same. She pleaded that such women be provided justice in making possible amendment in rules.
While replying  Minister of State for Power Vikar Rasool informed the House that the J&K Reservation  Act 2004 and rules made there under notified vide SRO-294 dated 21-10-2005, under Section 21 clause-III provides that a person claiming benefit for resident of Backward area or near the Line of Control must establish that he or she has resided there for a period of not less that 15 years before applying for the same.
Mr Vikar said provision has been kept in the rules to avoid availing of undu benefit by the vested interests. He said the people may play mischief on the grounds of fake marriages and the spirit of reservation rules will get defeated. However, he assured the House to look into the matter and take appropriate measures by discussing it at various levels in the Government.
