JAMMU, Mar 15: Presiding Officer Fast Track Court, Sanjeev Gupta today awarded life-imprisonment and fine of Rs 50,000 to one Nikhil Sharma, son of Ashok Sharma of Gurah Brahmana, Akhnoor who was facing trial for kidnapping and raping semi-mentally retarded 10 years old girl on May 25, 2008.
After hearing Additional Public Prosecutor for the State whereas Advocate PS Pawar for the accused, Presiding Officer Fast Track Court Sanjeev Gupta observed, “the accused had committed a heinous offence thereby stigmatizing the girl’s future as such liberal view cannot be taken in his favour.
After referring various judgments of the Supreme Court and High Court, the Court further observed, “the rape cases and cases relating to crime against women particularly pertaining to young female children have alarmingly increased in recent time”, adding “such cases require exemplary treatment and any liberal attitude by imposing meager sentence or taking too sympathetic view merely on account of young age of convict beside economic condition or other irrelevant considerations will be result wise counterproductive in the long run”.
With these observations, Court awarded rigorous life-imprisonment with fine of Rs 50,000 under Section to Nikhil Sharma. He was further sentenced under Section 363 RPC and awarded seven years rigorous imprisonment and fine of Rs 5000.
