MACT court awards Rs 2.35 crore in accident case

JAMMU, May 20: Presiding Officer Motor Accident Claim Tribunal Jaffer Hussain Beg today awarded about Rs 2,35,0000 along with 7.5 % interest per annum in an accident case in which 16 persons lost their lives and 9 others sustained injuries.
The accident had taken place on 24.11.2012 at Dharman in Ramnagar tehsil of Udhampur district due to the rash and negligent driving of vehicle bearing registration No.JK02J-1735.
After hearing both the sides, Presiding Officer directed Oriental Insurance Company to pay Rs about Rs 2.35 crore along with interest at the rate of 7.5 % per annum from the date of institution of the petition till its realization except on future loss of earning in injury cases.
“The amount of compensation under ‘no fault’ liability if granted and paid shall be adjustable. The payment of court fee shall be first charge on the awarded amount. The compensation shall be apportioned by the petitioners in equal shares in all the claim petitions in death cases”, the court said, adding “the shares of the minors shall be kept in fixed depot scheme in a recognized bank till they attain the age of the majority and 50% share of the other petitioners shall be kept under fixed deposit in a recognized bank for 5 years with liberty to draw monthly interest”.
The insurance company was directed to make payment of the awarded amount within a period of 30 days from the date of award through the Tribunal.
