One year imprisonment to husband for cruelty against wife

KATHUA, June 2: Judicial Magistrate,  First Class Billawar has awarded one year imprisonment and fine of Rs 1000 to one Ashok Kumar S/o Mast Ram of Dhar Dungu, Mohra Kund, tehsil Billawar facing trial in case of cruelty against her wife.
The brief history of the case is that on April 6 in the year 2013 his wife Rekha Devi of Dhar Dungu rushed to Police Station, Billawar in injured condition and filed a written complaint in Police Station Billawar along with his mother Kamla Devi.
In her complaint she said that six months back her marriage was solemnized under Hindu custom and law. After marriage she lived with her husband but from the first day her husband has shown cruelty against her and accused demanded dowry from her. She further alleged that her husband was beating and harassing her daily.
She in her complaint said that her husband was forcing her to get Rs 50,000 from her parental house. She said she pleaded before him that her parents were poor and they can not afford Rs 50,000 as dowry but paying no heed to the same, he threatened her that in case she will not get dowry she will be killed by him.
She said on April 13, 2013 he thrashed her and beat her with lathi and he hit her head with one stroke of lathi due to which she fell on ground and received abrasion on her her body.
Later she tried to return to her parents home but her husband crated obstructions and warned that he will eliminate her if she tried to return to her parental house. Next day her brother and sister visited her in-laws house and seeing her condition they narrated the same to the parents. After that her mother visited her in-laws house and took her daughter along to her house. Later Rekha filed the complaint in the PS Billawar.
On the basis of application police registered an FIR No 36/2013 U/S 498 A, 323 RPC at P S Billawar and started investigation.
After the investigation the challan was presented in the court of JMIC Billawar. After hearing Prosecuting Officer , Ch Asif Iqbal appearing for State  and Council for accused, the court has observed that prosecution has proved the case beyond  reasonable doubt and evidence of eye witness is also corroborated with other evidence. The Court further observed that the accused is proved to be guilty and liable to be convicted.
While disposing off the case the court awarded simple imprisonment for one year and a fine of Rs 1000 for the commission of offence U/S 498A, 323 RPC.
