POONCH, Oct 18: Terming the conspicuous silence of the PDP-BJP alliance on the J&K High Court’s verdict on reservation in promotions as conspiratorial, senior National Conference leader and Member Legislative Assembly Mendhar, Javed Ahmed Rana has exhorted upon the marginalized and downtrodden sections of society to see through the designs of the present dispensation and get ready for the fight to protect and safeguard their Constitutional rights.
While demanding an authoritative statement on the reservation policy from the present dispensation, Mr Rana warned that hiding behind a judicial verdict so poorly contested by the Government on a critical issue of equality of opportunity will not deter the aggrieved sections in holding the State Government squarely responsible for its tacit approval of the verdict as apparent from the judgment itself.
“The object of Article 16 of the Constitution of India is to attain equality of opportunity in employment under Government and the affirmative action envisaged therein aims at upliftment of the disadvantaged sections of society by providing a level playing field to all the citizens so as to avoid competition amongst unequals, said the MLA who expressed shock on how the law officers representing the Government in the court tried to defend the State’s Reservation Act and other relevant issues raised in the petition. The official respondents seems to have been setup by the anti-reservation elements in the Government, alleged the MLA.
He termed it shocking how the official respondents deliberately kept mum over the question of inadequate representation to marginalized sections of State in the services of Government employment, which warranted reservation in promotions, prompting the court to hold the reservation rules as invidious and unconstitutional.
The MLA has appealed to the legislators representing more than 60% of the State’s population which is going to be affected by the recent judgment to jointly fight the cause. Rana has warned the Scheduled Tribes, Scheduled Castes and other backward classes of perpetual socio-economic subjugation and discrimination if they fail to see through the actonian designs of the present dispensation which seems to be in collusion with the anti-reservation forces in the State adding that critical and sensitive issues of the marginalized communities are being tactfully thrown in the Courts’ court.
