Pre-arrest bail denied to husband, in-laws in dowry case

JAMMU, May 27; Principal Sessions Judge Jammu, R S Jain has rejected the bail application of husband and in-laws of a woman in dowry demand case.
According to the police case, Nazia Hussain, wife of Anwar Khursheed filed a complaint before CJM, Jammu, which was forwarded to SHO Police Station Channi Himmat for further action under law. In the complaint, it was mentioned that soon after the complainant’s marriage her husband and other members of in-laws family started harassing and torturing her for want of more dowry.
The complainant, who was carrying a child of two and half months in her womb, was brutally assaulted by in-laws in March 2014 as a result of which child died inside the womb and she had to be aborted.
After hearing Advocate RH Mir for the accused persons, Principal Sessions Judge observed, “while considering the claim of pre-arrest bail, one of the factors which has to be considered is with regard to the nature and gravity of the accusation”.
“In the present case, emphasis has been laid by the petitioners that the complainant gave her consent to the abortion. However, the advice of the doctors was that the abortion should be done to save the mother. It is to be noted that the serious accusations have been made by the complainant that the petitioners hit her on the abdomen which resulted in an abortion”, the court said, adding “she has averred that previous complaint was not considered by the police due to the pressure of the petitioners as her father is an ordinary citizen having no high connection”.
Looking to the serious nature of the allegations and the offences alleged against the petitioners, court said, “no ground has been made out by the petitioners for grant of anticipatory bail”. Accordingly, the bail pleas of Anwar Khursheed, complainant’s father-in-law Choudhary Farooq Alam, mother-in-law Hamida Bibi, sister-in-law Rasheed Bibi and uncle Tariq Iqbal were rejected.
