Prosecution failure leads to acquittal of accused involved in militancy activity

JAMMU, May 21: Principal Sessions Judge Poonch Jaffer Hussain Beigh has acquitted Mohd Rashid, son of Feroze-ud-Din of Mendhar, who was facing trial for the last 6 years for his alleged involvement in militancy activity as prosecution failed to prove the case.
After hearing both the sides, Principal Sessions Judge Poonch observed, “the prosecution has not produced the sufficient evidence to connect the accused with the crime”.
“The complainant and the other prosecution witnesses including the Investigating Officer have not been examined by the prosecution. If those prosecution witnesses would have been produced by the prosecution, they would have demolished the prosecution structure”, the court said.
“Judicial process cannot be issued in the instant case against the accused as the prosecution has not succeeded in proving the guilt of the accused”, the court further said and acquitted the accused of the charges leveled against him.
