SRINAGAR, Nov 8: Jammu and Kashmir High Court today granted two weeks to Commissioner Secretary Health to comply with the judgment for reinstatement of SKIMS doctor who was accused of forging his date of birth.
A single bench of Justice Mohd Yaqoob directed the CS Health to remain present on next hearing incase he defaulted.
“The tardy pace would suggest framing of rule. Now in view of the special circumstances as projected by Dar two weeks time is granted with a condition that no further time shall be sought. In case of default respondent CS shall have to remain present in person on the date of hearing,” the court said.
During the arguments counsel for SKIMS M I Dar stated that the committee could not meet in view of ill health of the CS who is the chairman of the committee.
The petitioner, Dr Syed Amin Tabish, was working as Medical Superintendent in SKIMS. But he was accused of tempering with his date of birth, and had allegedly shown his DOB 1957 instead of 1956.
On the basis of alleged misconduct, departmental enquiry was initiated and the petitioner was placed under suspension in year 2012.
The petitioner challenged the order of suspension before this court and the court decided the petition directing the respondent to conduct departmental enquiry and complete the same within six weeks and consider the case of petitioner for reinstatement of departmental review committee.
The departmental enquiry headed by Commissioner Secretary of Health who returned a finding in the enquiry report that the petitioner has not tempered his DOB and also recommended his reinstatement as Medical Superintendent.
The department failed to accept the recommendations of enquiry officer compelling the petitioner to file contempt petition against the contemnors including CS and Director SKIMS.
