SRINAGAR, Mar 14: Division Bench of the High Court comprising Justice Ali Mohammad Magrey and Justice Dhiraj Singh Thakur has issued notice to Nuzhat Gul, MD Golf Development and Management Authority (GDMA) Srinagar asking her to show cause as to why she shall not be proceeded against in terms of applicable law for obstructing a Judicial Magistrate from performing his duties.
“The report of Registrar Judicial reveals that the Special Mobile Magistrate (Traffic) Srinagar (Yahaya Firdous) has addressed a communiqué stating therein that while he was holding the Mobile Court at Nishat Road near Royal Golf Course on March 10, 2020, one lady Nuzhat Gul caused unnecessary obstruction and used a filthy language against the Magistrate”, the DB observed, adding “the Magistrate therefore has sought initiation of contempt proceedings against the lady”.
Stating that Registry has treated the communiqué of the Special Mobile Magistrate Srinagar as CM and listed for consideration, the DB observed, “perusal of the report of the Registrar Judicial accompanied with the communiqué of the Special Mobile Magistrate Srinagar reveals that Magistrate has literally been manhandled and the language used against him is deplorable”.
“However, before proceeding further we direct the Magistrate to file his own affidavit as also of the staff who were accompanying him on the alleged date of occurrence detailing out the events”, the DB said and directed the Registry to issue a notice at the official address of the lady named in the report of the Magistrate after ascertaining her particulars from the Commissioner Secretary Tourism Department asking her to show cause as to why she shall not be proceeded against in terms of applicable laws for obstructing a Judicial Magistrate from performing his duties.
