Sr AAG tenders apology for his conduct

Srinagar, Feb 12: In an affidavit submitted before the High Court, Senior Additional Advocate General AR Malik, while trying to justify his conduct of producing Additional Deputy Commissioner Anantnag in place of Deputy Commissioner Anantnag before the court has tendered an apology.
Justice Wasim Sadiq Nargal took serious note of professional misconduct by the Sr AAG and had directed him to file his personal affidavit explaining therein as to why he during the proceedings of the case didn’t bring to the notice of the court about the antecedents of the official instead having passed on the slip to the employee without informing the court after the hearing of the matter was over.
“That despite all these submissions if at any stage of proceedings there was any communication gap, the deponent along with two officials respondents submits an un-conditional apology and has full faith in judicial discretion and wisdom of the Hon’ble Court,” the affidavit reads.
The Sr AAG says that it was already in the knowledge of the High Court that the officer present in the court was the ADC.
“That the Hon’ble Court called the officer and even at that time the submission was made to the Hon’ble Court that the officer is Additional Deputy Commissioner Anantnag,” reads the affidavit.
The Sr AAG says that he had already made submission to the court twice about the ADC presence in the court.
“The submission was made in the open court in presence of Ms. Aasifa Padroo, Additional Advocate General, who also apprised the Hon’ble Court on 08-02-2023 that I had made the submission twice in the Court that the Additional Deputy Commissioner is present in the Court on 06-02-2023 and the case may be taken up for consideration,” reads the affidavit.
Sr AAG said that he holds the court in high esteem and there was no question of concealing the identity of the officer as there was no such reason in view of the facts and circumstances of the case for the Deputy Commissioner to evade his presence.
