Srinagar, Feb 10: Government informed the High Court that the Social Welfare Department (SWD) is unable to make promotion of Anganwadi Workers to the next higher post in view of the stay order passed by the court on the Government order in this regard.
The Mission Director ICDS J&K UT submitted this information in a contempt proceedings filed by the aggrieved Anganwadi Workers alleging therein that the authorities are not complying with the court directions passed way back in 2019.
The court while considering their plea and disposing of the matter of the aggrieved Anganwadi Workers had directed that their claim be accorded consideration within two months. Director submits that after receiving the aforesaid direction, immediate steps were taken to comply with the same in letter and spirit.
After thoroughly examining the case of Anganwadi Workers it has come to the fore that these Anganwadi workers being graduate are seeking promotion as supervisors in light of Government order passed in February 28, 2019 in supersession of all previous orders passed by the previous Governments from time to time, which regulates the mode method of determining the seniority of graduate Anganwadi workers.
Court has been informed that in light of the order of February 28, which provides that the seniority of Anganwadi workers who have acquired higher qualification (Graduation) during service shall be taken from the date of acquiring the higher qualification instead of the date of their initial appointment.
Court has further been apprised that the authorities were about to implement the aforesaid Government order, a group of Anganwadi workers not satisfied by the same, challenged it before the Jammu wing of high court and got the direction in April 4, 2019 that the Government order No. 76-SW of 2019 dated 28.2.2019 shall not be given effect to.
Court has been informed that the authorities will consider the claim of these Anganwadi workers regarding their promotion as supervisors in light of the Government order but could not proceed ahead due to stay order passed by the high court and apart from this various petitions are pending before Srinagar wing of high court where certain interim orders have been passed.
Director ICDS in order to settle the issue once for all seeks clubbing of all the pleas pertaining to the promotion of Anganwadi workers so multiplicity of judgments in these cases be avoided as the Government order applies to entire J&K UT and the authorities are unable to decide the fate of one group of Anganwadi workers under one court direction which amounts to commission of contempt of court for violating the other court direction.
