Violation of mandatory provisions leads to acquittal in NDPSA case

JAMMU, Jan 16: 2nd Additional Sessions Judge Jammu Virender Singh Bhou has acquitted one Sunny Khajuria in NDPSA case as there was sheer violation of mandatory provisions of Section 42 and 50 of the Act in the prosecution case.
After hearing Advocates Prince Khanna and Summit Khajuria for the accused, the judge said, “this court have no hesitation to hold that prosecution has miserably failed to prove the charges for the commission of the alleged offence against the accused Sunny Khajuria beyond reasonable shadow of doubt”.
“The benefit of doubt goes to the accused. The challan, as such, fails and it is accordingly dismissed and accused is acquitted of the charges for alleged offences”, the court said.
