10 yrs imprisonment awarded to clerk in forgery case

SRINAGAR, Aug 2: Second Additional Sessions Judge Srinagar Tahir Khurshid Raina has convicted one Tundup Guylson, clerk in the office of ARTO Leh in a forgery case and awarded him simple imprisonment of 10 years besides imposing fine of Rs 30,000.
The convict was booked by the Crime Branch Kashmir under Sections 420, 468, 467, 109 read with Section 120-B RPC.
After hearing both the sides on quantum of sentence, 2nd Additional Sessions Judge observed, “the court has found the accused guilty of forgery. He created fake Registration Certificates of the vehicles and thus concealed the identification of true owners of the vehicles”, adding “the Additional Public Prosecutor has made a submission that such vehicles in the trouble torn valley have been used in past in militant activities”.
“Participating in the trial doesn’t means that convict should be awarded a nominal sentence. He must remember that at the same time he was enjoying the bail that was subject to his participation in the trial without fail”, the court said, adding “convict is 64 years of age which is not on much higher side to call for a very lenient view”.
“His old aged parents can very well be taken care of by his brothers and his wife has recently got retired from Government service and she is quite educated to take care of children, who are not of tender age or minors”, the court further observed, adding “the offence committed by the accused has serious implications and horrible consequences in the society”.
“The punishment prescribed for commission of offence under Section 467 RPC is imprisonment for life or imprisonment of either description for 10 years and fine and in the case of 468 RPC it is 7 years and fine”, 2nd Additional Sessions Judge said.
Accordingly, court awarded 10 years simple imprisonment to the convict for commission of offense under Section 467 RPC with fine of Rs 20,000. He was also awarded five years simple imprisonment for commission of offence under Section 468 RPC with fine of Rs 10,000. “Both the imprisonments to run concurrently”, the court ordered.
In case of non-payment of fine, convict will further undergo imprisonment for a period of six months, the court further ordered.
