13 years RI awarded in kidnapping, rape case

JAMMU, Sept 26: Presiding Officer Fast Track Court Haq Nawaz Zargar today awarded 13 years rigorous imprisonment and fine of Rs 50,000 to Rinku Kumar, son of Bushan Kumar of Bishnah, who was involved in kidnapping and rape with minor.
After hearing APP Surekha Bhat for the State whereas Advocate Ashok Kumar for the accused, the Presiding Officer observed, “it is not only the duty of the court but social and legal obligations are -clearly enjoined upon it to impose adequate punishment according to law while taking into consideration not only the crime but also the criminal”.
“Furthermore, deterrence and reformation are primarily social goals. The convict has faced trial in the instant case for about five years. He must have faced the trauma and agony of the protracted litigation. Huge money would have spent by him for undergoing the trial in the instant case”, the court said, adding “he might have repented for the crime, he has committed, in currency of his incarceration”.
“Reformation of a criminal shall be the primary goal of administration of criminal justice. Keeping in view the age of convict, ends of justice would be meted out in case convict is sentenced to undergo rigorous imprisonment for 13 years”, the court said.
“The victim has to face and undergo a lot agony and also face humiliation and in terms of the Jammu & Kashmir Victim Compensation Scheme compensation of Rs  3 lakh will be a just and reasonable amount for providing financial assistance to the victim, which may be paid within a period of one month after the expiry of appeal time”, the court said, adding “this recommendation of compensation be submitted to the office of Chairman, District Legal Services Authority, Jammu and Member Secretary, State Legal Services Authority, for release of compensation under the scheme”.
