15 yrs RI awarded to two in gang rape case

JAMMU, Oct 22: Principal Sessions Judge Reasi RN Wattal today awarded 15 years rigorous imprisonment to Rinku Kumar, son of Gopal Krishan and Kuldeep Kumar, son of Tara Chand of Hansali Reasi in gang rape case. The court also recommended Rs 5 lakh compensation to victim in terms of Victim Compensation Scheme.
After hearing Public Prosecutor Ranjeet Kumar Gupta for the UT whereas Advocate Ashok Sharma for the accused, the court observed, “the nature of the offence committed by the accused plays an important role in awarding the punishment. One of the principles that judiciary has to kept in mind is that rape being a violation with violence of private person of a women causes mental scar, thus not only physical injury but a deep sense of some deathlessness shape is also inflicted”.
With these observations, court convicted each accused for commission of the offences under Section 366 and 376D read with Sections 109 and 34 of RPC and awarded rigorous imprisonment of two years and imposed fine of Rs 10,000 for the commission offence under Section 366 of RPC, rigorous imprisonment of 15 years and fine of Rs 50,000 each for the commission of offence under Section 376D of RPC. Both the sentences shall run concurrently.
