2 yrs imprisonment to clerk in trap case

JAMMU, Dec 12: Special Judge Anticorruption Jammu, Puneet Gupta today awarded two years imprisonment and fine of Rs 20,000 to Hira Lal Sharma, the then Clerk in the CAPD Department, who was caught red-handed by the Vigilance Organization.
According to the Vigilance case, on April 13, 2006 complainant lodged a written report mentioning that he got prepared the file for installation of Atta Chakki at Billawar. The file was sent to Deputy Commissioner, Kathua, who marked the same to the clerk of the Consumer Affairs Public Distribution Department. When the complainant visited the CAPD office, the clerk demanded Rs 2500 from the complainant.
Acting on this complaint, Vigilance Organization constituted a trap team and caught accused official red-handed while demanding and accepting bribe money. After completion of investigation, challan was presented in the court of law.
After hearing Chief Prosecuting Officer Parshotam Sharma appearing for the Vigilance whereas Advocate Anil Bargotra for the accused person, Special Judge Anticorruption observed, “the accused is held guilty for offences under Section 161 RPC and Section 5(1) (d) read with Section 5(2) of J&K Prevention of Corruption Act as the prosecution has been able to prove its case beyond shadow of doubt”.
While convicting the accused, the Court awarded two years imprisonment and fine of Rs 20,000 to the accused. The Court, however, clarified that both the sentences will run concurrently.
