2 yrs RI awarded in attempt to rape case

KARGIL, Sept 19: Principal District and Sessions Judge Kargil, Tahir Khurshid Raina today awarded two years rigorous imprisonment and a fine of Rs 5000 to one Sonam Gurmeet, who was involved in attempt to rape case.
This was one of the oldest case pending for the last 10 years in the court and was transferred from Sessions Court Leh to Sessions Court Kargil in the year 2006. The minor prosecutrix stood the test of cross-examination and the medical evidence also confirmed attempt of rape by the accused on her.
All the independent witnesses also confirmed the presence of accused at the residence of minor prosecutrix when this happening took place. The accused whom the prosecutrix was calling uncle took the advantage of absence of parents of the minor prosecutrix and attempted this ghastly act on her.
After hearing the counsels for both sides and taking into account the incriminating evidence, the Court convicted the accused for the offence under Section 376/511. However, keeping in view the mitigating circumstances projected before the court Principal District and Sessions Judge awarded two years rigorous imprisonment.
