REASI, July 30: Court of Principal Session Judge, Reasi today awarded rigorous imprisonment of 10 years to three accused for raping a 14-year old deaf and dumb girl in Mahore area on November 16, 2014.
Announcing the sentence, Principal Session Judge R N Wattal also imposed a fine of Rs 10000 on the each accused for the commission of offence under section 376 of RPC and six months rigorous imprisonment as well as fine of Rs 500 for the offence under section 363 of RPC.
Both sentences shall run concurrently and in default of payment of fine, the accused shall further undergo rigorous imprisonment of three months.
Brief facts of the case are that on November 18, 2014, father of the victim lodged a written complaint before SHO Police station Arnas informing that his daughter was raped by three accused on November 16, 2014 when she had gone to collect the leaves for goat.
During investigation, the offences under section 376/363/109 of RPC were established against the accused, namely Rakesh Singh alias Keshu, son of Tara Singh, Sanju Sharma, son of Tilak Raj and Rashpal Sharma, son of Nanak Chand, all resident of Kanthan, Tehsil Mahore.
It came to fore that the prosecutrix was taken by the accused to the forests when she was found alone. She was gang raped by the accused who fled away after committing the crime and left the victim nude, inundated with blood. Chargesheet in the case was presented before the Chief Judicial Magistrate Reasi on February 20, 2015 after which witnessed were examined.
After hearing arguments from both the sides, Principal Session Judge R N Wattal observed that rape is a heinous crime and accordingly each accused is sentenced to rigorous imprisonment of 10 years.
The court also recommended an amount of Rs 2 lakhs as compensation in terms of victim compensation scheme for the minor prosecutrix, if not paid already.
