3 convicted in acid throwing case

JAMMU, May 30: In the acid throwing case, Principal District and Sessions Judge, Pulwama, Abdul Rashid Malik today convicted three accused namely Nazir Ahmad Mir, Showkat Ahmad Mir and Mohammad Younis Mir, all the residents of Ratnipora and awarded them three years rigorous imprisonment and imposed fine of Rs 5 lakh.
The court also directed the State Government to pay Rs 3 lakh to the victim under Victims Compensation Scheme and extend free treatment.
While announcing the sentence, Principal District and Sessions Judge observed, “the imposition of appropriate punishment is the manner in which the court responds to the society’s cry for justice against the criminal”, adding “the justice demands that the court should impose punishment befitting the crime. Moreover, the court has to keep in mind the rights of the criminal but also the rights of the victim of the crime and the society at large while considering the imposition of appropriate punishment”.
Principal District and Sessions Judge further observed, “Section 542 of CrPC confers a duty on court to apply mind to the question of compensation in every criminal case”. Accordingly, the court directed the CMO Pulwama to provide the facility of ambulance to the victim during his treatment in the District Hospital Pulwama, SMHS Srinagar or in SKIMS Soura Srinagar or any other private hospital.
Moreover, free legal services shall be provided to the victim in case he feels any difficulty during the medical treatment or in case of any other administrative grievance, the court further directed, adding the Member Secretary J&K Legal Services Authority shall release an amount of Rs 3 lakh to the victim as compensation under J&K Victims Compensation Scheme, 2013.
