3 real brothers get life-imprisonment in murder case

JAMMU, Dec 30: 2nd Additional Sessions Judge Jammu Amit Sharma today awarded life-imprisonment to three real brothers in a murder case.

According to the prosecution case, the accused Harvinder Singh, Amarjeet Singh and Harcharan Singh, sons of Lakhmir Singh of Railway Patri, Tali Morh R S Pura, on 08.01.2014, killed Harnek Singh of R S Pura over some enmity.
After hearing APP Arvind Rathore for the UT whereas Senior Advocate Sunil Sethi for the accused persons, the court observed, “the murder in this case has been taken place due to some enmity and there is nothing on record to term this murder a case that falls within the definition of “rarest of rare” cases to warrant capital punishment”.
“In this backdrop, convict Harvinder Singh is convicted for the commission of offences under Sections 302/307/34 RPC and 4/25 Arms Act and sentenced to life imprisonment and fine of Rs 10,000 for commission of offences punishable under Section 302 RPC. The convict is also sentenced to imprisonment for a period of five years and fine of Rs 5,000 for the commission of offence under Section 307 RPC”, the court said, adding “the convict shall also undergo imprisonment of 1 year and fine of Rs 1,000 for the commission of offence under Section 4/25 Arms Act”.
“The convict Harcharan Singh is also convicted for the commission of offences under Sections 302/307/34 RPC and sentenced to life imprisonment and fine of Rs. 10,000 for the commission of offence under Section 302 RPC. The convict shall also undergo imprisonment for a period of five years under Section 307 RPC and fine of Rs 5,000. And in case of default of fine further undergo imprisonment of one month each in the respective offences”, the court said. The court further said, “convict Amarjeet Singh shall undergo life imprisonment for the commission of offence under Section 302 RPC. The convict is also sentenced to imprisonment for a period of five years and fine of Rs. 5,000 for the commission of offence under Section 307 RPC. He is also sentenced to imprisonment for a period of 1 year and fine of Rs 1,000 for offence under Section 427 RPC”.
