While acquitting the accused, the court observed, “prosecution has failed to prove the charge against the accused beyond any reasonable doubt and therefore, accused deserve to be acquitted by extending them the benefit of doubt”.
Before parting, the court expressed anguish over the inadequacy, haphazard and unfair investigation in the case and failure to fairly discharge the responsibility on part of the Investigating Officer.
The charge sheet owes its origin to the complaint received by Vigilance Organization that accused claimed Rs 15.00 lakh as CST refund for the year 1981 and same was paid to them illegally on the basis of forged and fictitious documents.
