JAMMU, Dec 12: As the entire citizenary including the litigants are in deep mental stress due to ill surge in COVID-19 pandemic, J&K Legal Services Authority and Ladakh Legal Services Authority under the stewardship of Patron-in-Chief and Executive Chairman, J&K Legal Services Authority Justice Rajesh Bindal, Chief Justice (A), High Court of J&K and under the guidance of Justice Ali Mohammad Magrey, Executive Chairman, Ladakh Legal Services Authority, organized National Lok Adalat throughout the UTs of J&K and Ladakh, today.
This National Lok Adalat was organized in all the districts of UTs of J&K and Ladakh to achieve the goal of access to justice for all and to help the poor litigants tide over their financial problems and untold mental stress.
As per the information received from the districts, out of a total number of 8007 cases taken up by 117 benches in the day long National Lok Adalat at various courts across the UTs of J&K & Ladakh, 4628 cases were disposed off and an amount of Rs 47,69,86,336 was awarded as compensation/settlement amount in civil, criminal, labour disputes, electricity and water bills cases, land acquisition, family matters, cheque dishonor and bank recovery cases.
MK Sharma, Member Secretary, J&K and Ladakh Legal Services Authority thanked all the participants including the Judicial Officers, Secretaries DLSAs, Advocates, representatives of insurance companies and banks, staff of the courts and legal services institutions and litigants for their pragmatic approach in settlement of cases in such a large number.
National Lok Adalat was organized at both wings of High Court J&K in the ADR Centres High Court Complex, Jammu/High Court Complex Srinagar.
National Lok Adalat was organized under the patronage of Justice Rajesh Bindal, Chief Justice, (Acting) High Court Jammu and Kashmir and Patron-in-Chief, J&K Legal Services Authority/Executive Chairman J&K Legal Services Authority and under the guidance of Justice Dhiraj Singh Thakur, Judge High Court of J&K and Chairman J&K Legal Services Committee.
Total 75 post-litigation and 42 pre-litigation of different nature like MACT cases, criminal compoundable cases, bank recovery cases (pre-Litigation) etc. were listed before the Adalat.
Two Lok Adalat benches comprising of RN Watal, Special Judge Anticorruption, Srinagar and MS Parihar, Special Judge Anticorruption (CBI), Srinagar were constituted for High Court wing, Srinagar.
Two Lok Adalat benches comprising of Sunit Gupta, 3rd Additional Sessions Judge, Jammu and Ritesh Dubey, District and Sessions Judge, (One Man Forest Authority), Jammu were constituted for High Court wing, Srinagar.
In both wings of High Court, 28 MACT cases and 8 bank cases (recovery) pre-litigation were settled and Rs 1,30,20278 was awarded as compensation. Rs 30,30,000 lakhs awarded in MACT cases and Rs 5,0,4300 lakhs settled in Bank recovery suits. Rs 80,300 was realized in various criminal compoundable cases.
JAMMU: A National Lok Adalat was held here in the District Court Complex, Janipur under the chairmanship of Sanjeev Gupta, Chairman, District Legal Services Authority (Principal District and Sessions Judge) Jammu and under the overall supervision of Naushad Ahmed Khan, Secretary District Legal Services Authority. A total number of seven benches were constituted. The first bench, presided over by the Chairman DLSA (Principal District and Sessions Judge) Jammu Sanjeev Gupta and assisted by Additional Anti-Corruption/Jammu, CL Bavoria, dealt with MACT and consumers cases. The second bench, presided over by Additional District Judge Nighat Sultana, Bank cases, Jammu and assisted by 1st Additional District and Sessions Judge YP Kotwal and Secretary District Legal Services Authority, Naushad Ahmed Khan, dealt with bank cases. The third bench, headed by Special Judge Anti Corruption, Jammu, YP Bourney and assisted by 2nd Additional District and Sessions Judge, Jammu, Virinder Singh Bhou, dealt with matrimonial and civil cases. The fourth bench, headed by Sub-Judge Special Mobile Magistrate, Surjeet Singh Bali, and assisted by Municipal Magistrate Jammu, O.P Bhagat, dealt with municipal and revenue cases. The fifth bench, headed by Railway Magistrate, Jammu, Perveiz lqbal and Prem Sagar, City Judge Jammu, was assisted by Urvashi Raina, Munsiff, Jammu, dealt with cases under Section 138 N I Act cases and criminal compoundable offences. The sixth bench presided over by Sub-Judge Electricity Magistrate, Jammu, Sudesh Sharma and assisted by Forest Magistrate, Jammu, Shabnam Sheikh and Excise Magistrate, Jammu, Rajni Sharma, dealt with electricity and water cases. The seventh bench presided over by Special Mobile Magistrate, Passenger Tax Jammu, Sandeep Gandotra and assisted by Special Mobile Magistrate Traffic, Jammu, Dinesh Gupta, dealt with civil cases. In all 360 cases were taken up, out of which 234 cases were decided. A total of Rs 36.41crores was settled in the Lok Adalat. Lok Adalat Benches were also constituted at Tehsil Headquarters at Akhnoor, Bishnah and RS Pura which were presided over by respective Chairman, Tehsil Legal Services Committees.
RAJOURI: National Lok Adalat was held at District Court Complex here under the chairmanship of Jaffer Hussain Beg, Principal District and Sessions Judge, in which two benches were constituted. First bench was headed by Kusoom Lata Pandita, Additional District and Sessions Judge Rajouri and assisted by OP Thakur, Chief Judicial Mobile Magistrate Rajouri, while the second bench was headed by Meyank Gupta District Judicial Mobile Magistrate (T) Rajouri and assisted by Manzar Khayam APP CJM Court Rajouri. Similar benches were also constituted at Tehsil level, which were headed by the presiding officers of the respective courts. A total of 186 cases were taken up, out of which 111 cases were disposed off and an amount of Rs 859550 was settled. From the court of Principal District and Sessions Judge Rajouri and Additional District and Sessions Judge Rajouri, 27 MACT cases were taken up and all were disposed off and an amount of Rs 34,40,000 was awarded as compensation. Total amount awarded was Rs 42,79,550.
SAMBA: A National Lok Adalat was organized here at District Court Complex under the chairmanship of MA Chowdhary, Chairman DLSA (Principal District and Sessions Judge). Two benches were constituted including a special bench for taking up MACT and Bank cases, Pre-Litigation matters and all cases referred by District Judge which was headed by MA Chowdhary Principal District and Sessions Judge and assisted by Swati Gupta, Secretary, DLSA, Samba. Second bench was presided over by Pooja Raina (Munsiff), Samba and Rashi Verma Additional Munsiff Samba for taking up Cr Compoundable cases of all nature, NI Act and petty offences and labour disputes. In all 152 cases were taken up by the two Benches, out of which 119 cases were disposed of amicably and an amount of Rs 34.56 lakh was settled.
UDHAMPUR: A National Lok Adalat was organized by District Legal Services Authority Udhampur in District Court Complex here under the chairmanship of Mohan Lal Manhas, Chairman District Legal Services Authority (Principal District and Sessions Judge) Udhampur. A total number of five benches were constituted. The first bench was presided over by Mohan Lal Manhas, Principal District and Sessions Judge, Udhampur and Sobha Ram Gandhi Additional Session Judge Udhampur. The second Bench was presided over by Sandeep Kour Sub Judge, Secretary DLSA Udhampur and Preet Simran Kour Sub Judge Special Mobile Magisterate Udhampur. The third Bench was headed by Girja Shavan, Additional Special Mobile Magistrate Udhampur and Kamiya Singh Munsiff, JMIC Udhampur. Fourth bench was headed by Munsiff Chenani, Amandeep Kour and assisted by Advocate AS Katoch and Balwan Singh and the fifth bench was headed by Munsiff Priyanka Gupta Munsiff Majalta and Saqib Saleem Tehsildar Majalta. A total of 209 cases of different nature were taken up, out of which 109 cases were settled on the spot. Total of Rs 3614600 was realized in different cases settled on spot. An amount of Rs 30,30,000 was awarded as compensation in MACT cases while a total of Rs 5,04,300 was realized in various bank cases. Besides, fine amounting Rs 80,300 was realized in respect of various criminal compoundable cases. Similar Lok Adalats were also organized at Tehsil Headquarters Chenani and Majalta.
KATHUA: A National Lok Adalat was held here in the premises of District Court Complex under the supervision of Pawan Dev Kotwal, Chairman District Legal Services Authority, Kathua. Two benches were constituted to settle the cases. First bench comprised of Pawan Dev Kotwal, Principal District and Sessions Judge and Jatinder Singh Jamwal, Additional District and Sessions Judge Kathua, while second bench consisted of Yashpal Sharma, Chief Judicial Magistrate Kathua and Rekha Kapoor Nischal, Munsiff JMIC Kathua. A total of 285 cases were taken up, out of which 32 cases were settled. A compensation worth Rs 21,05,000 was awarded in the MACT cases and a recovery of Rs 1,58,000 was also made in favour of the banks. Meanwhile, Lok Adalats were also organized by Tehsil Legal Services Committees Hiranagar, Basholi, Bani and Mahanpur.
KISHTWAR: District Legal Services Authority organized National Lok Adalat in the District Court Complex here under the chairmanship of Principal District and Sessions Judge Kishtwar, Sham Lal Lalhal. Three benches were constituted for the said purpose. A total of 339 cases were taken up in the said National Lok Adalat, out of which 67 cases were amicably settled and an amount of Rs 60,025,000 was awarded as compensation in MACT cases and labour disputes and Rs 11,700 was released as fine in traffic challans.
BHADERWAH: National Lok Adalat was held in the District Court complex under the chairmanship of Principal District and Sessions Judge, Bhaderwah (Doda), Ashok Kumar Shavan. Seven benches were constituted to deal and settle the cases referred to the Lok Adalat. A total of 43 cases were taken up in the Lok Adalat in which bank matters, labour disputes, civil and criminal cases were settled. An amount of Rs 5,37,000 was recovered as fine which was ordered to be deposited in the Government treasury.
REASI: District Legal Services Authority under the chairmanship of Kamlesh Pandit Principal District and Sessions Judge organized National Lok-Adalat. In the National Lok-Adalat, 303 cases of different nature were taken up and 43 cases were settled and settlement amount of Rs 8.77 lakh was awarded in MACT cases/Recovery cases and Rs 10,800 was recovered as compounding fine in other cases. Four benches for settling the referred cases were constituted. The first bench was presided over by Kamlesh Pandit, Principal District and Sessions Judge, Reasi who was assisted by Rimpi Rani, JMIC/Munsiff Reasi, the second bench was presided over by AS Langeh, Sub Judge/CJM, Reasi who was assisted by Assma Choudhary, Additional Special Mobile Magistrate Reasi, while the third bench was presided over by Romesh Lal, Chairman, Tehsil Legal Services Committee (Sub-Judge) Katra who was assisted by Sunil Kumar, Munsiff/JMIC, Katra and 4th bench of Lok-Adalat was presided over by Mahavir Singh, Chairman, Tehsil Legal Services Committee (Munsiff/JMIC) Mahore who was assisted by BAR President Mahore.
POONCH: A National Lok Adalat was held here at District Court Complex, which was presiding over by the Chairman DLSA Poonch, Madan Lal. At District Headquarters two benches were constituted. First bench was presided by Madan Lal Chairman DLSA (Principal District and Sessions Judge) Poonch and assisted by Bhanu Bhasin DMM (T) and Advocate Mohammad Ishfaq. The second bench was presided by Som Lal CJM (Chairman TLSC Poonch) and assisted by Advocate Mohammad Aslam Chouhan. The Surankote bench was presided by Aehsan-Ul-Haq Malik Chairman TLSC/Sub- Judge Surankote and assisted by Shafiq Ahmed, Additional Mobile Magistrate Surankote. At Mendhar, the bench was presided by Raj Kumar Lalhal Chairman TLSC (JMIC) and assisted by Sahil Chandal SDM Mendhar. A total 146 cases were taken up out of which 116 cases were settled. A total amount of Rs 45.64 lakh was settled.
SRINAGAR: National Lok Adalat was organized under the chairmanship of Principal District and Sessions Judge Srinagar, Abdul Rashid Malik. He also inaugurated the Lok Adalat at District Court Complex Moominabad in which cases as per NALSA direction were fixed. During the adalat, 10 benches were constituted which took up a total of 3374 cases out of which 2229 cases were amicably settled. Beside this Rs 1,07,75000 was awarded as compensation by MACT Srinagar and Rs 1,73,37,300 as settlement amount by different courts in different cases. A fine of Rs. 4, 36,050 has also been collected. Secretary DLSA Srinagar Adnan Sayeed coordinated the National Lok Adalat.
BANDIPORA: National Lok Adalat was organized at District Court Complex under the chairmanship of Syed Sarfaraz Hussain Shah, Chairman DLSA (Principal District and Sessions Judge). During the proceedings, four benches were constituted, they took up 143 cases out of which 93 were settled amicably and an amount of Rs 1.60 lakh was realized as settlement amount.
PULWAMA: District Legal Services Authority (DLSA) Pulwama organized Lok Adalat under the supervision of Mohammad Ibrahim Wani, Chairman DLSA, Pulwama and Principal District and Sessions Judge here. During the Lok Adalat, a total of 211 cases were taken up out of which 169 cases were amicably settled by constituted benches and an amount of Rs. 42.63 lacs were paid in the settlement of different cases. Similar Lok Adalats were also held at all Subordinate courts in the district that were presided over by the respective Chairman Tehsil legal Services Committees.
GANDERBAL: DLSA Ganderbal organized the National Lok Adalat at District Court complex here, under the supervision of Principal District and Session Judge, M Yousuf Wani. During the adalat, 24 pre- litigation cases and 128 pending cases were posted for settlement out of which 75 cases were settled and an amount of Rs 38, 69,200 was settled.
KULGAM: National Lok Adalat was held in District Court Complex here under the chairmanship of Mohammad Ashraf Malik Chairman District Legal Services Authority and Principal District and Sessions Judge, Kulgam. During the adalat, four benches were constituted, two at Headquarter and one each at DH Pora and Qazigund. A total of 92 cases were taken up out of which 36 cases were amicably settled and an amount of Rs 8,40,000 was realized in different cases related to bank cases and labour cases etc besides an amount of Rs 29,500 was also imposed as fine in criminal RPC challan and traffic challan cases.
SHOPIAN: Lok Adalat was held within the court premises of District Court Complex here under the chairmanship of District Legal Services Authority Shopian. During the adalat, three benches constituted to hear the cases took up a total of 153 cases out of which 117 cases have been settled by Mediation and reconciliation. An amount of Rs. 74902 was recovered as fine and an amount of Rs 17, 14,000 was recovered in bank recovery cases, besides an amount of Rs. 1365,900 was awarded under Negotiable instrument act.
KARGIL: A National Lok Adalat was held here during which two benches were constituted–one each at District Court Complex Kargil and Munsif Court Drass. The bench at District Court Complex Kargil comprised of the Munsiff/JMIC, Sankoo Tsering Wangyal as Chairman and Advocate Khadim Hussain as Member while as the bench at Drass comprised of the Munsif Drass/Additional Special Mobile Magistrate, Drass Tsewang Phuntsog and Tehsildar, Drass Asgar Ali. A total of 121 cases were taken up for hearing during the Lok Adalat out of which 102 cases of different nature were settled amicably. An amount of Rs 58200 was recovered as fine.
