5-yr imprisonment, penalty for rash driving

Srinagar, Dec 26: Chief Judicial Magistrate Ganderbal today awarded five years imprisonment and penalty of 20 lakhs to an accused for attempted murder of two boys 10 years ago.
The CJM court presided over by Fayaz Ahmad Qureshi sentenced the accused Mehraj Ud din Dar of Ganderbal to five year simple imprisonment for Commission of offence Under Section 304 of RPC.
“The accused is also convicted to one month simple imprisonment for the offence under Section 279 RPC. Besides, the accused shall in terms of Section 545 (3) Cr.P.C pay a compensation amount of rupees ten lacs to  the family members of each of the deceased to compensate them for the loss they suffered due to sudden death of the deceased young boys”, reads the judgment
Court has also convicted and sentenced him to one year imprisonment for the commission of offence under Section 338 RPC. “Besides, the accused shall pay compensation of Rs. 50,000 to the injured Adil Majeed within a period of two months in default of which he shall undergo further simple imprisonment of 3 months”. Apart from the above, the accused is fined Rs. 25,000.
The court after awarding the sentences of different offences said of imprisonment so awarded for the offences said these shall run concurrently.
“The period for which the accused was arrested in connection with this case, which the accused has undergone during investigation, shall be set off from the sentence”, reads the judgment.
Since the accused is on bail as such the withdrew the concession of bail and directed he is to be and sent to District Jail Ganderbal for serving his sentence.
The prosecution case reveals that  on 11-12-2013 Police Station Ganderbal learnt from reliable source that on general road of Bamloora, Ganderbal, one tipper bearing registration No.JK16/4098 driven by accused- Dar from Ganderbal to Zazna hit one motor cycle on which three persons were riding.
As a result of which all the three persons got injured on the spot. The driver of the tipper fled away along with his vehicle. The occurrence took place due to rash and negligent driving of the accused and so on.
