5 yrs imprisonment to 2 in murder case

JAMMU, Oct 9: Principal Sessions Judge Udhampur, A K Koul today awarded five years imprisonment and fine of Rs 10,000 each to Rattan Singh, son of Bindu and  Rangil Singh, son of Chuni Lal under Section 304-II (culpable homicide not amounting to murder).
According to police case , on July 23, 2009 the accused persons, who were participating in a marriage ceremony in the neighborhood of  Kewal Kumar (deceased), picked up a quarrel with the deceased and then pushed the deceased about 40 feet down as a result of which the latter sustained severe injuries in his back. He was shifted to hospital on July 24 and accordingly a case under Sections 307/323/341/34 RPC was registered against accused in Police Station Basantgarh.
After hearing Advocate Ajay Bandral for the accused persons whereas PP Navneet Gupta for the State, Principal Sessions Judge observed, “keeping in view all other relevant factors like the manner in which the crime was committed, weapon used by accused, the age, social status of accused, their domestic problems etc, I believe that the submission of accused merits consideration”.
“Rattan Singh being a police official would loose his job which would not only effect him but also his family as well. He has an aged mother and wife who is suffering from tuberculosis. Rangil Singh is young man of 26 years of age and his future is virtually ruined, even if a lesser sentence is imposed on him”, the Court said, adding “the ends of justice would be met with if a lenient view is taken against the accused/convicts while awarding the sentence”.
Accordingly, the court awarded five years imprisonment and fine of Rs 10,000 each to both the accused persons.
