6 accused facing trial in murder case acquitted

JAMMU, May 11: Principal Sessions Judge Ramban, Mohd Akram Choudhary today acquitted six accused facing trial in the murder case as prosecution failed to prove its case.
Those who have been acquitted are Giyan Chand, son of Thakar Dass, Tej Ram, son of Shib Ram, Pyar Singh, son of Suram Chand, Lal Singh, son of Thakur Dass, Chuni Lal, son of Lehnu Ram and Mansa Ram, son of Shib Ram, all the residents of Mavalkote, Ramban.
According to the police case, on June 26, 2010 these accused persons killed Sansar Chand, son of Rasila Ram of Mavalkote and critically injured his wife Amri Devi.
After hearing both the sides, Principal Sessions Judge observed, “it has been brought on record that there was enmity between the deceased and the accused over a piece of land regarding which there were criminal and civil cases pending in the Courts, However, no such case was concluded from which inference could be drawn that the accused had killed deceased and injured Amri Devi”.
“On the other hand, it seems that out of their zeal to settle scores with the accused complainant party they planned to implicate many of the innocent accused and this was the reason why the injured  and her daughter had not made statement for more than one and a half months from the date of occurrence”, the Court said, adding “the confessional theory, if believed, the same is not found compatible with the direct evidence propounded by the eye witness. The confessional disclosure and the statement of the sole eye witness are not found trustworthy on the principles of criminal jurisprudence to be relied upon to base conviction”.
“In this backdrop of the matter the prosecution has not succeeded to bring home the charge against any of the accused”, the Court said while acquitting the accused of the charges leveled against them.
