7 yrs RI awarded in rape case

JAMMU, Sept 26: Additional Sessions Judge Udhampur S R Gandhi today awarded seven years rigorous imprisonment to Surinder Singh, son of Krishan Singh of Kotli Jija Udhampur, who was facing trial in a rape case.
After hearing both the sides, the court observed, “the impact of rape by cheating and fraud is not less than other rapes. It causes stronger psychological impact when the victim feels betrayed and cheated by the vile act of a person to whom she trusted a lot but that man in order to appease lust invaded her person”, adding “a woman’s body is not a man’s plaything and he cannot take advantage of it in order to satisfy his lust and desires by fooling a woman into consenting to sexual intercourse simply because he wants to indulge in it”.
“In view of aggravating and mitigating circumstances of this case, for the commission of offence under Section 376 of the RPC, the convict Surinder Singh shall undergo rigorous imprisonment for seven years and a fine of Rs 5,000. For the commission of offence under Section 417 of the RPC the convict shall further undergo rigorous imprisonment for one year and a fine of Rs 2,000”, the court said.
Both the sentences shall run concurrently and in default of payment of fine, the convict shall further undergo imprisonment for six months, the court added.
