8 yrs old boy released on HC direction

Srinagar, Aug 8: High Court today directed the Senior Superintendent of Police Pulwama to handover an 8-year old boy to his mother and report compliance to the court.
Justice MH Attar while taking cognizance of a news report that among 80 persons who have been arrested by the Police in South Kashmir’s district Pulwama, an 8-year old boy has also been arrested.
However, senior Police Officer said that the boy is not 8-year old but 14 year of age and is studying in 8th class. “He was arrested on charges of stone pelting and was let off today on the directions of the Jammu and Kashmir High Court”, he said.
Court directed the Senior Superintendant of Police to handover the custody of the boy Basit Manzoor to his mother forthwith and report handing over of the custody to the Registrar Judicial of the court.
Court referred the Section 82 and 83 of the Ranbir Penal Code which provides that nothing is an offence which is done by a child under 7 years of age and above 7 years of age but under 12 years of age, who has not attained the sufficient maturity of understanding to judge the nature of the consequences of his conduct on that occasion.
Court rapped the authorities of lodging the boy in police station and said the child was to be dealt with in accordance of J&K Juvenile Justice Act.
Court also directed District Judge and Chief Judicial Magistrate of Pulwama to get the boy examined by the Doctor and sent report through fax to the Registrar Judicial of this court within two days. Court in view of the urgency of the matter asked state counsel B A Dar (AAG) to appear in the matter and take notice.
