HC directs for release of salary to MD JK Cements

Srinagar, July 30: High Court today directed for release of salary to Managing Director JK Cements Ltd since September last year as he has made all efforts to comply with the directions of the court.
Ishtiaq Hussain Drabu, MD of the JK Cements Ltd, has filed an application seeking modification of the order of court dated 30.9.2019 passed in contempt petition filed by the employees of the Corporation whereby Court had directed that no employee of Corporation including Managing Director of JK Cements Ltd shall draw or disburse his salaries for the month of September 2019 and subsequent months.
Drabu projected before the court through his counsel Arif Sikander that he approached the erstwhile State Government and sought assistance to overcome the financial crisis in the Corporation (JK Cements Ltd) and the then Government especially Principal Secretary to Industries and Commerce Department came to rescue of the Corporation by providing Rs 5 crores grant in aid for procurement of raw material to restart the operation of the plants of the Corporation.
Advocate Sikander also apprised the court that the Corporation has paid five months pending salary to its each employee from January 2019 onwards and the applicant has been making every effort by taking up the matter with the Government for release of grants for the employees of the Corporation.
Court has recorded the submission of the counsel that Drabu has made efforts for release of salary of the employees of the Corporation and the fiancé department has conveyed its authorization to release an amount of Rs 2.5 crores for salary components to the employees of the corporation.
“In view of the facts and circumstances of the case, the applicant is permitted to draw his salary as well as arrears thereof. The order dated 30.9.2019 with the said modification shall remain in force”, court of Justice Rajnesh Oswal directed.
Subordinate employees of Corporation have approached to the court with a plea that their salary and other allowances be paid and the court had directed the MD to ensure payment of regular salary to the employees of the Corporation at the end of every month.
When the said direction was not implemented, employees have filed a contempt petition against the higher-up including MD seeking implementation of the said direction and the court on 30.9.2019 directed in case the salary of the employees is not released, no employee of the corporation including the MD shall draw or disburse their salaries for the month of September and subsequent months.
